GENERAL TERMS AND CONDITIONS
1. Scope of application
The following Terms and Conditions shall govern all orders placed via our online shop.
2. Contractual partner, customer service
The sales contract is concluded between Musikcenter Scharte e.K. Further information on us can be found in the legal notice. Questions, queries, complaints and claims can be directed to our customer service department from Mo to Fri, 10 am to 6 pm (telephone number +49 (0) 5258 - 55 55).
3. Conclusion of contract
The product presentation in the online shop is no legally binding offer, but merely a non-binding online catalogue. By clicking the order button you make a binding order of the goods contained in the product basket. The confirmation of receipt of order is sent along with the order acceptance, immediately after sending the order, by an automatic email. A sales contract is concluded by submission of the email confirmation.
In case you chose PayPal as a means of payment, the sales contract is concluded at the time of confirmation of the payment order with the payment service provider.
For an effective conclusion of a contract it is essential that the order process is completed on submission of the order.

The shipping costs within Germany amounts to € 5.50. As of an order value of € 50 we deliver free of shipping costs.

Shipping address and billing address
In case you are frequently not at home during normal DHL delivery times, we can also deliver to an alternative address of your choice.
For orders outside the EU levies and duties may apply which shall be borne by the client on the spot.
Payment by credit card:Visa Mastercard
For credit card payments you can use MasterCard, VISA and American-Express. Payment by credit card is processed via Paypal. For payment via credit card you do NOTneed a Paypal account.
Your credit card account will be charged upon completion of the order.
We kindly ask you to transfer the invoice amount to our bank account within 14 days from the request for payment. There is no possibility of cash discount deduction. The goods will be shipped after receipt of payment.

In order to ensure a quick allocation of incoming payments, please enter the order number and, if applicable, your customer number as reason for payment.
After completing your order you will be redirected to the secure pages of PayPal. You have to be registered there or register first, legitimize with your access data, select one of your saved payment methods as usual and confirm the payment instruction to us. After completion of the transaction you will be redirected to our store.

If you use the PayPal Express order processing via the PayPal Express button, you will be directed to Paypal. Here you only need to log in and confirm your purchase. All order details (billing and shipping address) will be transmitted to us by Paypal.
6. Reservation of title
The goods will remain our property until full payment is made.
7. Transport damages
In case the goods have been delivered with obvious transport damages, please immediately make a complaint with the delivery agent and also contact us immediately. Failure to make a complaint or make contact with us shall not have any consequence for your statutory claims, in particular warranty rights. But your support helps us to assert our claims against the deliverer or the transport insurer.
8. Revocation instructions
Consumers are entitled to the right of revocation according to the following conditions, whereby the consumer is any natural person entering into a legal transaction for a purpose that can be attributed neither to a commercial nor a self-employed occupational activity.
You have the right to return the received goods without giving any reasons within 14 (fourteen) days after you or a third person designated by you, who is not the transport company, took possession of the goods.
In order to exercise your revocation right,a clear statement on your intention to withdraw from the contract must be submitted e.g. via mail, fax or email to us (, , - ) You may use the sample revocation form in annex; this is, however, not mandatory. For compliance with the revocation period it is sufficient to notify us on the revocation before expiration of the revocation period.
Consequences of a revocation (Return and Refund)
In case of an effective revocation we shall return any payments received by you, including delivery costs (with the exception of additional costs which were incurred because you chose another type of delivery than our inexpensive standard delivery) immediately and, at the latest within 14 days as of the date we received your notification on the revocation of the contract. We will use the same means of payment you used in the initial transaction for repayment, unless otherwise agreed with you; we will not charge any fees for repayment.
I We may refuse to make repayment until we have received all the goods or received evidence that you have shipped the goods to us, whichever occurs earlier. You shall return the goods immediately to us or hand the goods over to us, at the latest within 14 days as of the date you notified us on the revocation of this contract. The deadline is met if you dispatch the goods before expiration of this deadline. You shall bear the costs for returning the goods.
The consumer shall only be liable for any diminished value of the goods resulting from the handling other than what is necessary to ascertain the nature and functioning of the goods.
The right of revocation does not apply to goods and services, which have been designed after customer specification or clearly are tailored to individual conditions.
